The personal data we collect from you will be used for the following purposes, which are necessary for the service you request:

General

In accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter the “Law”) and its Regulations, we ask you to read this Privacy Notice (the “Notice”), as it contains the terms and conditions applicable to the Personal Data collected by VIRKET. If you grant your consent, your personal information will be used to provide the services and products you have requested, to inform you about changes to them, and to evaluate the quality of our service.

Controller

As part of its normal activities, and in accordance with its lawful corporate purpose, VIRKET may collect and store information considered Personal Data.

Data Collected

The Personal Data you provide to the controller, or that may be generated through visits to the VIRKET site, will vary in each specific case depending on your activities on the site, and will be the following:

A. If you submit comments through the contact form: only the following Personal Data will be collected and stored: General Data: full name (the one you provide), your email address and anything else you enter in the comments. In all cases, the accuracy and truthfulness of the Personal Data collected will rest with you, as you are the one who has access to your social media profiles and the one who provides the information.

B. In all cases, when accessing the VIRKET site, data will be collected through Cookies and Web Beacons. These elements collect the IP address, browser type and operating system, the web pages you visit, browsing and consumption habits and patterns, the links you follow, and the site you visited before reaching ours. From all the Personal Data mentioned above, a user profile is created, used for the purposes described later.

Sensitive Personal Data

VIRKET does not collect Sensitive Personal Data.

Processing Purposes

Your Personal Data will be used and processed for the following purposes, exhaustively described below:

A. Primary purposes.

• In case you fill out the contact form, to contact you, resolve your questions, and propose a commercial relationship or possible business based on your needs or those of the company you represent.

B. Secondary purposes.

• To identify, locate, communicate, contact, and send you information, as well as for statistical and scientific use (metrics analysis).
• To develop, by ourselves or through affiliates or any third party, studies on the interests, behaviors, and demographics of Holders, in order to better understand their needs and interests, and to offer better news services.
• To improve our initiatives and commercial strategies.
• To analyze the websites visited and the searches performed by Holders, as well as to improve our content and article offerings, including their personalization, presentation, scheduling, and services.
• To send information via email regarding relevant news or events.

Transfers

VIRKET will not transfer your Personal Data without your consent, although it may use it for purposes that depend on third parties, such as statistics and the sending of newsletters, without any transfer of said Data. If you do not consent to your personal data being transferred under the terms set forth in this privacy notice, you may request it through your account.

Term

The handling of Personal Data will be of indefinite duration from the date you provided it to the Controller, and you may of course object at any time you deem appropriate, for the purposes of blocking and cancellation.

Storage

Once you provide the Controller with your Personal Data through any means, we state that it will be kept in a CRM system of the site's own archive, access to which will be limited to the Controller only. Your personal data will at all times be processed lawfully and observing the principles of Lawfulness, Consent, Information, Quality, Purpose, Loyalty, Proportionality, and Responsibility, in compliance with the provisions of the Law.

Your ARCO Rights

Any questions about this Notice, your Personal Data and its processing, or how to exercise the rights described below, may be addressed at (+52) 55 52 92 70 28, Monday to Friday from 9:00 to 19:00, on business days.

You will have access to your Personal Data at all times, whether to request its rectification, cancellation, opposition, or to revoke your consent, in accordance with the Law (the “ARCO Rights”), in written or electronic form. You must direct your request to VIRKET's legal department at the following address: Prol. Paseo de la Reforma 1015 Floor 7, Santa Fe, Cuajimalpa, Mexico City, 05349, Mexico; or by email to legal@virket.com.

Your request must include the following:

1. Photograph or scan of your official identification with photograph and handwritten signature; or, if acting on behalf of someone else, also attach a copy of the notarized power of attorney and/or registered with the corresponding Public Registry and, where applicable, the articles of incorporation.
2. Scan or photograph of proof of address.

In your written request you must:

1. State your name or corporate name and provide a physical address for the dispatch of the response, communications, and documentation.
2. Inform us of the Personal Data you wish to access, or that you wish to be rectified, canceled, or reviewed, as well as to object to processing or revoke your consent.
3. State whether you know or remember the purpose for which you provided the data and the name of the Controller to whom you provided it.
4. Clearly, respectfully, and concisely state your request, and provide any other information or document that facilitates the location of your Personal Data.

The Controller will have a period of twenty days, from the date the request is received, to resolve it or request further information. If your request is found valid because you proved your identity and your Personal Data could be located in our database, it will be processed within no more than fifteen days. The Controller will keep you informed of the process at any time you request.

The response and access to your Data, as well as supporting documents, may be delivered, after verification of identity and/or legal capacity, through certified copies by the Committee and its legal representative, electronic documents, or simple copies. Whenever the request is made through electronic means, those means will be preferred for sending responses and resolutions.

In the event that the Controller requires using your Personal Data for purposes other than those indicated in this Privacy Notice, you will be contacted in writing, by phone, electronically, or by any other optical, sound, or visual means that technology may allow now or in the future, and the new uses intended for such information will be explained in order to obtain your consent.
